Under 21 DUI Arrest

In Georgia drivers under the age of twenty one are guilty of a DUI Per Se if their blood alcohol level is .02 grams or more.   An under 21 DUI Defendant is facing mandatory jail time, probation of at least 12 months, a minimum of forty hours  community service, and significant fines from the court.

Unlike other first time DUI offenders the Blood Alcohol Level directly effects how long an under 21 DUI Defendant will have their driver’s license suspended for.  If the Blood Alcohol Level is under .08 after 6 months from the license revocation the individual may apply for his license to be reinstated.  If the blood alcohol level was 0.08 or more the revocation is for 12 months.  Prior to reinstatement a Drug and Alcohol Risk Reduction School must be completed.
