Refusals

There is no correct answer whether to submit to the officer’s request for blood, breath, or urine in a DUI case.  The short answer is, if you blood alcohol content is over the State’s legal limit there is no more powerful piece of information for the prosecutor in court.

Many choose to refuse the state requested blood alcohol test.  If the state does not have a test they are left to prosecute for DUI Less Safe.  A DUI Less Safe means you were drinking and it the alcohol made you a less skilled or effective driver.  This issue will be left to your jury to decide.
